By using the Sport Team FUNDAMENTALS™ resources, you certify that you have read and reviewed this Agreement and that you agree to fully comply with its terms.
1. INTELLECTUAL PROPERTY RIGHTS
Excellence with Integrity Institute, hereafter the INSTITUTE, is the owner of the intellectual property rights in the Sport Team FUNDAMENTALS™ and Excellence with Integrity TOOLS® resources, associated assessment instruments, and related materials, as well as the trademarks listed herein. These resources are collectively referred to as the FUNDAMENTALS and are protected by copyright and trademark laws in the United States.
2. CONDITIONS OF USE
You agree to be bound by all of the following terms and conditions:
- LIMITED USE. Authorized use of the FUNDAMENTALS resources and materials is limited to supporting coaching and educational objectives, such as instruction and assessment for the purposes of student-athlete learning and development, in your role as a coach of a single pre-collegiate or collegiate athletics team/sport. Any transfer, publication, distribution, performance, or display of these resources and materials, or of the content contained in these resources and materials, to individuals or entities who are not Authorized Users is expressly prohibited.
- TERM OF USE. Authorized use of the FUNDAMENTALS resources and materials is limited to the duration of your subscription, and is considered terminated if subscription is not renewed for a new term whereupon all use of the materials shall immediately cease.
- AUTHORIZED USERS. Authorized users are you, the Coach of a single pre-collegiate or collegiate athletics team/sport, as well as the coaching staff working with this team, and the student-athletes in this team.
- YOUR OBLIGATIONS. You agree to use treat the content of these materials and resources as protectable by the United States Copyright Act, and you will take all necessary and reasonable steps to ensure that the authorized users act in accordance with these terms and conditions.
- TERMINATION. If any breach of these Terms and Conditions continues for more than thirty (30) days after receipt of written notice of such breach from the INSTITUTE, this Agreement is considered terminated whereupon all use of the materials shall immediately cease.
3. EXTERNAL CONTENT
- The FUNDAMENTALS resources and materials may include references to excerpts from the work of individuals or entities not affiliated with the INSTITUTE, such as video clips, articles, etc., intended for illustration of the instructional content, consistent with principles 1, 3, and 4 of the Fair Use Law.
- The INSTITUTE makes no claims of intellectual property rights to the external content referenced in these resources, nor does the INSTITUTE claim to have made any efforts to obtain such rights or obtain licenses for reproduction and/or distribution of the external content in any form.
